2. DEFINITION

  • "Terms of Use": refers to these Terms and Conditions of Use
  • "GALENIC", "We": refers to GALENIC, a simplified joint stock company that markets GALENIC brand cosmetics
  • "Party" refers to either GALENIC or the User, and "Parties" refers to GALENIC and the User
  • "Site": refers to the GALENIC website accessible at https://www.galenic.com
  • "User(s)", "You": refers to any individual browsing the Website or creating a user account

3. PURPOSE OF THE TERMS AND CONDITIONS OF USE

The purpose of these General Terms and Conditions of Use is to define the conditions of access and use of the GALENIC website, as well as the rights and obligations of the User when browsing the Website and creating a user account.
They constitute a legally binding contract between GALENIC and the User. They are available on the Website in French. In the event of translation into another language, only the French version shall be deemed authentic in the event of a dispute.
Any use of the Website or creation of an account implies full, complete and unreserved acceptance of these Terms and Conditions.
It is specified that if the User places an order for GALENIC products via the Website, GALENIC's General Terms and Conditions of Sale, also available on the Website, shall apply to said transaction.
The General Terms and Conditions of Use may be updated at any time by GALENIC.
Any changes will take effect as soon as they are posted online and will apply immediately to any new access to the Website.
Users are invited to regularly consult the latest version of the Terms and Conditions available on the Website. Use of the Website after the update constitutes acceptance of the new Terms and Conditions.
If the User does not accept the Terms and Conditions, they are invited to immediately cease browsing the Website.

4. SITE ACCESS AND TERMS OF USE

4.1 Access to the Website

Access to the Website is free for any User with internet access. All costs associated with accessing the Website, whether hardware, software or internet access costs, are the sole responsibility of the User.

4.2 Account creation

To create an account, the User must:
Be a natural person of legal age and legally competent,
Provide accurate and up-to-date information,
Create a secure password (uppercase letters, lowercase letters, numbers and special characters),
Agree to keep this information up to date.
The password must be at least 12 characters long and remain strictly confidential. The User undertakes not to impersonate a third party or create an account under a false identity.
In the event of inactivity for more than 24 months, GALENIC reserves the right to delete the user account after informing the User by email at least 30 days in advance.
The User is responsible for the confidentiality of their login details and must immediately inform GALENIC in the event of fraudulent use of their account.

Are the exclusive property of GALENIC and are protected by the Intellectual Property Code and international treaties in force.
Any reproduction, representation, adaptation, modification, translation, distribution or exploitation, in whole or in part, of all or part of the Website or its content, for commercial or non-commercial purposes, without the prior written authorization of GALENIC is strictly prohibited.
GALENIC grants the User a personal, non-exclusive, non-transferable and revocable right to access and consult the Website solely for private and personal use.

The User expressly agrees not to:

  • Reproducing or copying the content of the Website for the purposes of scraping, automated indexing or data extraction;
  • Attempting to access the source code of the Website or its databases.

6. LIABILITY

GALENIC makes every effort to ensure that the Website is accessible under the best possible conditions. However, GALENIC does not guarantee continuous, uninterrupted or error-free access.
GALENIC cannot be held liable for:

  • Interruptions, slowdowns or malfunctions of the Website due to maintenance operations, technical failures or force majeure,
  • The temporary inability to access the Website due to circumstances beyond its control.

6.2 Limitation of liability

GALENIC cannot be held liable for:

  • Loss, alteration or fraudulent access to user account data due to mismanagement or error on the part of the User,
  • Accidental transmission of information, data or other harmful elements via the Website,

GALENIC's liability shall not exceed the direct damage suffered by the User, provided that the User is able to demonstrate this damage and prove a causal link between the Site and the damage claimed.

8. COMPLAINTS

Any requests for information or complaints relating to these Terms of Use should be addressed to Customer Services using the contact form available on the Website or by emailing:contact@galenic.com.
Any complaint must be made within 30 days of the event in question. After this period, it will be deemed inadmissible.

9. APPLICABLE LAW AND JURISDICTION

These Terms of Use are subject to French law. In the event of a dispute, and after seeking an amicable solution, the courts within the jurisdiction of the Court of Appeal shall have sole jurisdiction.
In the event of a dispute with a consumer, in accordance with Article L.612-1 of the French Consumer Code, the User may have recourse to a consumer mediator free of charge.

10. GENERAL PROVISIONS

These Terms of Use constitute the entire agreement between the Parties and replace any previous version, subject to the application of GALENIC's Terms and Conditions of Sale to purchases made on the Website.

10.1 Non-waive

If one or more provisions of these Terms of Use are deemed invalid or unenforceable, this invalidity shall not affect the validity of the other clauses.
The fact that one of the parties does not invoke a breach shall not be interpreted as a waiver of the obligation in question.

10.2 Force majeure

The parties agree that they cannot be held liable in the event of force majeure within the meaning of applicable case law.
