Online sale of GALENIC cosmetic products
1. PREAMBLE
These General Terms and Conditions of Sale ("GTC") are agreed between GALENIC Cosmetics Laboratory, a simplified joint stock company (SAS), whose registered office is located at 3 rue du colonel Moll, 75017 Paris, registered with the Paris Trade and Companies Register under number 889 310 108, and any person located in the European Union wishing to make a purchase on the website https://www.GALENIC.com.

2. DEFINITIONS
- "GTC": refers to these General Terms and Conditions of Sale
- "GALENIC", "We", "Seller": refers to GALENIC, a simplified joint stock company that markets GALENIC brand cosmetic products
- "Customer(s)", "You", "Buyer(s)": refers to any natural person of legal age and legal capacity who places an order for products on the website for personal and non-professional purposes
- "Party(ies)": refers individually or collectively to GALENIC and/or the Customer(s)
- "Products": refers to the cosmetic products offered for sale on the Website
- "Website": refers to the GALENIC website accessible at https://www.galenic.com
3. PURPOSE OF THE GENERAL TERMS AND CONDITIONS OF SALE
The purpose of these General Terms and Conditions of Sale is to define the conditions applicable to online sales by GALENIC to Purchasers of Products, as well as their rights and obligations when placing an order for Products.
Any order for a product on the website requires that the Customer be a consumer acting in a non-professional capacity, aged over 18, and that they accept these GTC without reservation.
The Customer acknowledges that they have read and accepted these terms and conditions by clicking on the button on the Website: "Finalise your order". The Customer also acknowledges that they have consulted the privacy and cookie policy before confirming their order.
The applicable GTC will be those in force on the date of the order. They cannot be modified retroactively.
4. PRODUCTS
4.1 Product Compliance
The Products comply with French legislation in force at the time of the order. They are manufactured in accordance with European standards applicable to cosmetic products (EC Regulation No. 1223/2009).
By accepting these T&Cs, the Customer expressly acknowledges that they are aware of this compliance and accepts that the Products are designed, manufactured and marketed in accordance with French standards.
GALENIC cannot be held liable in the event of non-compliance with the legislation of another country in which the Product is delivered, used or consumed.
The Customer remains solely responsible for ensuring that the Products can be legally imported or used in the country of destination.
The information on the packaging is available in French and English. GALENIC does not guarantee translation into all official languages of the European Union.
The Customer is also informed that certain Products may contain ingredients that could cause allergies or reactions. It is advisable to read the labels and instructions carefully.
4.2 Product description
The Products offered for sale are those appearing online on the Website at the time of consultation, subject to availability.
GALENIC takes the utmost care in describing and representing its Products. However, the photographs are for illustrative purposes only and are not contractually binding on GALENIC.
In the event of a minor difference between the packaging delivered and the image displayed on the Website, the conformity of the product cannot be called into question.
4.3 Ownership of products
The Products ordered remain the exclusive property of GALENIC until full payment of the price by the Customer. Transfer of ownership is subject to full payment of the price, but transfer of risk occurs as soon as the Products are taken over by the carrier.
5. ORDERS
5.1 Ordering conditions
Products ordered on the Website are intended for the personal and non-professional use of the purchaser, excluding any resale or distribution by the Customer.
The Customer may not order more than 5 (five) units of the same Product per single order, and within the limit of a total order amount of 1,500 (one thousand five hundred) Euros, including delivery costs and all taxes.
Any order exceeding these limits may be cancelled by GALENIC without notice.
5.2 Ordering process
The Customer acknowledges that, prior to placing an order, GALÉNIC has provided them with:
- All information on the essential characteristics of the Products,
- The terms and conditions of ordering, delivery, payment, and the guarantees applicable to the Products,
- Personalized advice available via the Website,
- And, in general, the information required by the Consumer Code (in particular Articles L.111-1 et seq.).
To place an order, the Customer:
- Select the Product(s) of their choice and add them to their basket via the Website's web interface,
- Provides the information necessary to fulfil their order (name, address, email, delivery details, etc.),
- Views a summary page showing the Product(s) selected, their price, delivery costs and can apply any discount codes,
- Accept these GTC by ticking the dedicated box,
- Confirm your order by clicking on the payment button.
The personal data provided is processed in accordance with our privacy policy and is necessary for the execution of the order.
5.3 Payment
The Customer enters their credit card details, which are processed exclusively via the secure Shopify Payment platform.
Only Visa, Mastercard and American Express credit cards are accepted.
Once the payment has been validated, an order confirmation email is sent to the Customer.
Payment is due immediately upon placing the order.
5.4 Order refusal
GALENIC reserves the right to refuse or cancel any order in the event of:
- Ongoing or previous disputes with the Customer,
- Total or partial non-payment of a previous order,
- Fraudulent or suspicious use of the payment method,
- An order that does not comply with these T&Cs,
- Attempt to place an order exceeding the limits defined above.
6. PRICES AND PAYMENT TERMS
6.1 Prices
The prices of the Products displayed on the website are in euros (€), inclusive of all taxes (VAT included), and take into account the VAT applicable on the day of the order, but do not include delivery costs.
Delivery costs will be indicated separately before the final confirmation of the order and will then be invoiced as an additional charge.
6.2 Price changes
GALENIC reserves the right to change the price of Products at any time without notice. These changes will not affect orders that have already been confirmed, paid for and confirmed.
In the event of an obvious error in the price displayed (ridiculously low or clearly incorrect price), GALENIC reserves the right to cancel the order.
7. DELIVERY
7.1 Delivery times - Risks
The standard processing time varies between 2 and 4 working days from the date of order confirmation.
The maximum delivery time is 30 days from the date of order confirmation.
Products are transported at the Customer's risk as soon as they are taken over by the carrier.
7.2 Delayed delivery
In the event of a delivery delay, the Customer is invited to contact GALENIC via the contact form or via the address contact@GALENIC.com so that an investigation can be opened with the carrier.
If the order cannot be found after the investigation, GALENIC will issue a full refund for the order (including delivery costs).
A delivery delay of more than 30 days entitles the Customer to cancel the sale and receive a full refund for the order.
7.3 International delivery
GALENIC delivers its products to most countries, both within and outside the European Union, subject to legal or logistical restrictions specific to certain territories.
For any order delivered outside the European Union, the Customer is informed that the Products may be subject to customs duties, import taxes and local VAT. These costs are the sole responsibility of the Customer.
Products are transported at the Customer's own risk once they have been taken over by the carrier.
The Customer is informed that deliveries outside the EU may be delayed due to local customs procedures.
8. RECEIPT OF PRODUCTS
8.1 Absence at the time of delivery
If the Customer is absent at the time of delivery, the parcel will be delivered to the nearest collection point and will remain available there for 14 calendar days.
8.2 Verification upon receipt
Upon receipt of the Products, the Customer must check that the order delivered is complete, compliant and has not been damaged.
In the event of any apparent anomaly, the Customer must immediately notify the carrier of their reservations and inform GALENIC within a maximum of 10 days of receipt. The Customer must provide photographic evidence in the event of a damaged Product.
8.3 Missing or non-compliant Product
In the event of a missing or non-compliant Product:
- An investigation will be opened with the carrier,
- If the Product is not found within 30 days, GALENIC will send a new shipment or issue a refund,
- If the delivered Product is non-compliant, the Customer must return it unused, unopened, in its original packaging.
9. RIGHT OF WITHDRAWAL AND RETURNS
9.1 Withdrawal period
In accordance with Article L.221-1 et seq. of the French Consumer Code (in particular L.221-18), the Customer has a period of 14 calendar days from the date of receipt of the order to notify GALENIC of their wish to exercise their right of withdrawal.
Once this right has been exercised, the buyer has an additional 14 days to return the Products.
9.2 Return conditions
For reasons of hygiene and safety, Products must be returned:
- Unused and unopened,
- In their original, intact packaging,
- In a condition that allows them to be resold as new,
- Accompanied by the return slip provided by GALENIC,
- Products returned damaged, opened or used will not be eligible for a refund.
9.3 Return address

9.4 Return costs
Return shipping costs are covered by GALENIC, provided that the Customer uses the return slip provided and complies with the return shipping terms and conditions. Any returns that do not comply with the procedure (outside the time limit, without a return slip) may be refused by GALENIC.
9.5 Refund
If the Products are returned in accordance with the conditions, GALENIC will refund the sums paid by the customer. The refund will be made using the same payment method as the one initially used, within a maximum period of 14 days from receipt of the returned product.
10. LEGAL WARRANTIES
GALENIC is bound by the legal guarantee of conformity of the Products under the conditions of Article L. 217-3 et seq. of the French Consumer Code and the guarantee against hidden defects under the conditions provided for in Articles 1641 et seq. of the French Civil Code.
10.1 Implementation of guarantees
In the event of a lack of conformity or hidden defect, the Customer must return the Product in its original condition, with the original labels and, if possible, the original packaging, accompanied by the invoice.
The Customer must first inform GALENIC using the contact form available on the Website.
10.2 Follow-up
If the defect is confirmed, GALENIC will, as appropriate, replace the non-compliant or defective Product, or refund it and reimburse the initial delivery costs.
Any refund will be made within 14 days of confirmation of the defect by our services.
11. ARCHIVING AND PROOF OF THE CONTRACT
Invoices relating to orders will be archived by GALENIC for:
- 5 years from the last delivery for orders of € 120 or less (including VAT)
- 10 years from the last delivery for an order amount greater than € 120 including VAT.
The storage of the order, confirmation, invoices and any correspondence on GALENIC's computer systems shall be considered as proof of the sales contract. The Customer may request a history of their invoices at any time via their personal account or by contacting customer service.
12. LIABILITY
The Customer expressly acknowledges that the use of the Products sold on the Website is their sole responsibility.
GALENIC cannot be held liable for any use of the Products that does not comply with their intended purpose, the recommendations in the instructions, or the precautions for use.
GALENIC's liability, when incurred, shall not exceed the total amount of the order concerned. The Customer is solely responsible for the choice of products ordered and their compatibility with their needs.
13. COMPLAINTS AND MEDIATION
13.1 Complaints
Any complaints relating to these GTC must be addressed to Customer Service via the contact form available on the website or by email to:contact@galenic.com . The Customer undertakes to attempt an amicable resolution with Customer Service before resorting to mediation.
13.2 Mediation
In the event of a persistent disagreement, the Customer may refer the matter to the CMAP (Centre de Médiation et d'Arbitrage de Paris) mediator at 39 avenue Franklin D. Roosevelt 75008 PARIS or via the website: www.cmap.fr.
It should also be noted that the European Commission has set up an Online Dispute Resolution platform, accessible at the following link: https://ec.europa.eu/consumers.
All communications with customer service are treated confidentially. Your personal data is protected in accordance with the GDPR and is only used to process your request.
Communications with customer service may be retained for the purposes of improving our services and training our teams, in accordance with confidentiality requirements.
14. APPLICABLE LAW - JURISDICTION
These T&Cs are subject to French law. In the event of a dispute, and after seeking an amicable solution, the courts within the jurisdiction of the Paris Court of Appeal shall have sole jurisdiction.
15. INTELLECTUAL PROPERTY
15.1 Protected elements
All elements appearing on the Website in connection with Product orders, in particular:
- The "GALENIC" brand and its derivatives and variations,
- Trade names, domain names,
- Graphic elements, graphic charter, Product layout,
- All content relating to the products (descriptions, images, photographs, illustrations, animations, videos, sounds, databases, logos, etc.),
- The presentation and content of product sheets,
Are the exclusive property of GALENIC and are protected by the Intellectual Property Code and international treaties in force.
Any violation of these rights may result in civil and criminal proceedings in a French court.
15.2 Prohibitions
Any disassembly, decompilation, decryption, extraction, reuse, copying and, more generally, any act of reproduction, representation, adaptation, modification, translation, distribution and use of these elements, in whole or in part, for commercial or non-commercial purposes, without the prior written authorization of GALENIC is strictly prohibited and may be subject to legal proceedings.
15.3 Authorised use
Ordering Products on the Website does not entail any transfer or concession of intellectual property rights to the Customer. The purchase only confers on the Customer a right to personal use of the Product(s) ordered, to the exclusion of any resale or commercial distribution.
16. GENERAL PROVISIONS
16.1 Entire agreement
These GTC and the order summary constitute the entire contractual relationship between the Parties.
16.2 Independence of the provisions of the GTC
If one or more provisions of these GTC are deemed invalid, this invalidity shall not affect the validity of the other clauses.
16.3 Force majeure
The Parties agree that they cannot be held liable in the event of force majeure within the meaning of applicable case law.
16.4 Modification of the General Terms and Conditions of Sale
GALENIC reserves the right to modify these General Terms and Conditions of Sale at any time. Any modification will be published on the Website and will take effect as soon as it is posted online.
The applicable General Terms and Conditions of Sale are those in force on the date of the order. By continuing to use the Website and placing orders after the publication of the amendments, the Customer accepts the new terms and conditions.
The Customer is advised to consult the GTC regularly to be aware of any updates.
